Expungement, Resentencing, or Redesignation of a Marijuana-Related Conviction in Montana

If you have a qualifying marijuana-related conviction on your record from a Montana state court, you can ask to have your conviction:

  • Removed from your record, also known as expunged (if you’ve completed your sentence for the crime);
  • Resentenced (if you’re currently serving that sentence) to a lesser sentence; or 
  • Redesignated as a civil infraction (if the previously criminal act is now a civil infraction under the Montana Marijuana Regulation and Taxation Act).
