There is a new law now in effect. If a property manager charged you an application fee when you applied to rent a place, they may have to give your money back if you didn’t end up signing a rental agreement.
Here are a few things to keep in mind:
- This only applies to application fees paid after October 1, 2025 (this is when the law went into effect)
- The property manager must have at least 4 units
- If the application fee included costs related to specific services (such as checking your credit), they can keep that part of the fee if they actually performed that service on your application and if they gave you written notice when you paid the fee saying what services were covered by the application fee
