Do you need help with a divorce or parenting plan?

The Self-Help Law Unit (SHLU) provides free information, advice and assistance to help you get your own Divorce or Parenting Plan!

What does the Self-Help Law Unit do?

The SHLU is part of the Montana Legal Services Association (MLSA). We offer low-income Montanans information, legal advice and guidance on how to represent themselves to get a divorce or parenting plan. A paralegal or attorney works with each participant to prepare their court documents.  Once the documents are complete, participants meet with an attorney who reviews the documents.  The attorney makes suggestions to improve the documents.  Then the paralegal gives the final documents to the participant along with detailed instructions on how to file the documents with the court.  The SHLU helps you get the information you need to make your own decisions and represent yourself!

How does it work?

You will receive a packet of information and sample forms.  You also get instructions on how to use a computer program that will ask you questions.  The computer program uses your answers to create the court documents you need to get your divorce or parenting plan.   If you can't use the computer program yourself, a paralegal can help you.  Once you have your documents, an attorney will go over them with you to look for problems or mistakes.  A paralegal will make the corrections that the attorney suggests and you agree to.  Then, you will get information and advice about how to file your documents with the court and finish your case.  Your work will be "pro se," which means that you will represent yourself in court.

Do I have to do all the documents myself?  I don't have a computer.

No.  You will need to answer written questions and gather information about your situation. Once you have done this you will have two choices. You can either:

1. If you are comfortable using computers, you can go online and enter your answers into an online form. This will make complete legal forms for you.  Most libraries have public access computers if you don't have one at home.

2. If you would like some help, you can send your information to the SHLU. Our staff and volunteers will then enter the information for you.

Why should I go through the SHLU when I could just get on the computer and do it all myself?

The SHLU gives you the chance to work with a paralegal to get help and advice.  A paralegal will work with you to make sure your forms are complete.  You will also have an attorney review your documents and discuss them with you.  Not only will the attorney look for mistakes, but the attorney will check to make sure what is in the documents matches what you want.

How can I be sure my documents are correct and legal?

Once you complete your documents, you and an attorney will review them together. This way, you will be able to make sure everything is correct. You may meet with the attorney face-to-face or over the telephone.
